Child & Spousal Support
Spousal Support
Spousal support is not favored in Texas. If you are seeking spousal support from your soon-to-be ex-spouse, or if you are expected to pay spousal support, it is important to work with an attorney to ensure that your individual rights are protected throughout the process. This is an important legal matter that could affect your life for years to come.
How Alimony Is Determined in Texas
The intent of alimony is to ensure that a spouse that might be incapable of supporting themselves has the financial resources to sustain themselves. Spouses can work together to determine an appropriate amount and duration of spousal support. If they are unable to come to an agreement, a family law judge will make a determination. A number of factors are considered, including the length of the marriage, the age of each spouse, the earning capacity of each spouse, non-monetary contributions to the marriage and more.
Child Support
In Texas, child support is determined based on the child support guidelines. The guidelines are a percentage of an individual’s income less certain deductions. Typically, the noncustodial spouse is required to pay child support to the custodial spouse on a monthly basis. At our firm, we represent men and women who are both receiving support and obliged to pay support obligations.
